Online Store Terms and Conditions

I. General Provisions

  1. These Terms and Conditions define the general rules, the manner of providing services electronically, and sales conducted via the Online Store www.hedcomet.com. The store is operated by Kosciuschko Group Sp. z o.o., ul. Kredytowa 8/2, 40-562 Katowice, registered in the National Court Register by the District Court Katowice-East, Economic Division VIII of the National Court Register under KRS number: 0000697520, NIP 6342907120, REGON 368393715, hereinafter referred to as the Seller.

  3. These Terms and Conditions are continuously available on the website www.hedcomet.com, in a manner that allows their acquisition, reproduction, and retention of their content through printing or saving on any medium at any time.
  4. The Seller informs that using services provided electronically may involve risks for every Internet user, such as the possibility of introducing harmful software into the Client’s IT system or unauthorized access and modification of data. To minimize these risks, the Client should use proper technical measures, especially antivirus programs and firewall protection.
II. DefinitionsTerms used in the Terms and Conditions mean:
  1. Business Days – days from Monday to Friday excluding public holidays;
  2. Client – a natural person with full legal capacity, a natural person running a business, a legal person, or an organizational unit without legal personality, granted legal capacity by specific regulations, who places an Order in the Online Store or uses other Services available in the Online Store;
  3. Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
  4. Account – a part of the Online Store assigned to a Client, through which the Client can perform specific actions within the Online Store;
  5. Consumer – a Client who is a consumer within the meaning of Article 22[1] of the Civil Code;
  6. Entrepreneur – a Client who is an entrepreneur within the meaning of Article 43[1] of the Civil Code;
  7. Terms and Conditions – this document;
  8. Goods – a product presented in the Online Store, with a description available for each product;
  9. Sales Agreement – a Sales Agreement for Goods under the Civil Code, concluded between the Seller and the Client;
  10. Services – services provided by the Seller to Clients electronically within the meaning of the Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws No. 144, item 1204, as amended);
  11. Consumer Rights Act – Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, No. 827);
  12. Act on Electronic Services – Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws No. 144, item 1204, as amended);
  13. Order – a declaration of intent by the Client directly aimed at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
III. Rules for Using the Online Store
  1. Using the Online Store requires the Client’s IT system to meet the following minimum technical requirements: a) computer or mobile device with Internet access b) email access c) web browser: Internet Explorer 11 or newer, Firefox 28.0 or newer, Chrome 32 or newer, Opera 12.17 or newer, Safari 1.1 or newer d) enabling Cookies and JavaScript in the browser.
  2. Using the Online Store means any action by the Client that leads to familiarizing with the content in the Store.
  3. The Client is obliged, in particular, to: a) not provide or transmit content prohibited by law, e.g., content promoting violence, defamatory, or infringing on personal rights or other third-party rights, b) use the Online Store in a manner that does not disrupt its operation, especially through software or devices, c) refrain from sending or posting unsolicited commercial information (spam) in the Online Store, d) use the Online Store in a way that is not burdensome to other Clients or the Seller, e) use all content in the Online Store only for personal use, f) use the Online Store in compliance with Polish law, the provisions of these Terms and Conditions, and general Internet usage rules.
IV. Services
  1. The Seller provides free Services through the Online Store, available 24/7.
  2. The Account service is available after registration, completed by filling out and accepting the registration form provided on the Online Store. The Account service agreement is concluded for an indefinite period and can be terminated when the Client requests account deletion or uses the “Delete Account” button.
  3. The Client may receive commercial information via email (Newsletter). To do this, the Client must provide a valid email address or activate the appropriate option in the registration or Order form. The Client can withdraw consent at any time. The Newsletter agreement is concluded for an indefinite period and terminates when the Client requests removal from the subscription or uses the unsubscribe link in the newsletter.
  4. The Seller may organize occasional contests and promotions, with conditions provided on the Online Store pages. Promotions cannot be combined unless stated otherwise.
  5. If the Client violates these Terms and Conditions, the Seller, after a prior unsuccessful warning and setting a deadline, may terminate the Services agreement with 14 days’ notice.
V. Procedure for Concluding a Sales Agreement
  1. Information about Goods on the website, including descriptions, technical and functional parameters, and prices, constitutes an invitation to conclude a Sales Agreement under Article 71 of the Civil Code.
  2. All Goods in the Online Store are brand new and legally introduced to the Polish market.
  3. Submitting an Order requires an active email account.
  4. Orders placed via the online Order form are submitted electronically and constitute an offer to conclude a Sales Agreement. The Client is bound when the Seller sends a confirmation of acceptance, at which point the Agreement is concluded.
  5. Orders placed via phone or email are processed on Business Days and within hours indicated on the Online Store website. The Client must provide: a) the name and quantity of the Goods, b) delivery method and payment option from those offered, c) necessary details such as name, address, and email.
  6. The total Order value is communicated by the Seller verbally or via email, along with information that placing the Order constitutes a payment obligation, at which point the Agreement is concluded.
  7. For Consumers, the Seller sends a confirmation of the Order terms after placement by phone or email.
  8. The Agreement is concluded when the Consumer sends an email confirming acceptance of the Order and Terms and Conditions.
  9. After concluding the Sales Agreement, the Seller confirms its terms via email or in writing.
  10. The Agreement is concluded in Polish or English, consistent with the Terms and Conditions.
VI. Delivery
  1. Delivery is limited to the EU and sent to the address provided by the Client.
  2. Delivery methods: a) courier service, b) to a Parcel Locker.
  3. The Seller informs the Client about delivery times and fees on the product page.
  4. Delivery time is calculated in Business Days according to VII.2.
  5. The Seller provides proof of purchase.
  6. If Goods have different delivery times, the longest period applies to the entire Order.
VII. Prices and Payment Methods
  1. Prices are in PLN, GBP, or EUR, including VAT, customs, and other fees.
  2. Payment methods: a) bank transfer (Order processing begins after confirmation and payment receipt), b) electronic payment (Order processing begins after confirmation and payment verification), c) the Seller informs the Client of the payment deadline. Failure to pay may result in contract withdrawal under Art. 491 of the Civil Code.
VIII. Right of Withdrawal
  1. Consumers may withdraw within 14 days without giving a reason.
  2. To withdraw, notify Kosciuschko Group Sp. z o.o., ul. Kredytowa 8 lok 2; 40-562 Katowice, contact@hedcomet.com via a clear statement (letter or email). A template is optional. Sending the statement before the deadline is sufficient.
  3. The 14-day period starts from the day the Goods are delivered or, for Services, from contract conclusion.
  4. Upon receiving the withdrawal statement, the Seller will confirm receipt via email.
  5. Withdrawal rights do not apply to: a) fully performed services with Consumer consent, b) contracts with prices dependent on financial market fluctuations beyond Seller’s control, c) custom-made or personalized Goods, d) perishable Goods or those with a short shelf life, e) sealed Goods that cannot be returned for health/hygiene reasons if opened, f) Goods inseparably combined with other items after delivery.
  6. For distance contracts, the Agreement is considered not concluded. Returned Goods must be in original condition, unless altered for inspection. Return within 14 days to the Seller’s address.
  7. The Seller refunds all payments including delivery costs within 14 days using the same payment method unless agreed otherwise. Refunds may be delayed until the Goods are returned or proof of dispatch is provided.
  8. Additional costs for non-standard delivery are not refundable.
  9. The Client bears only direct return costs unless the Seller agrees otherwise.
  10. Right of withdrawal applies to individuals acting on business contracts if the contract is non-professional. Other entrepreneurs have no withdrawal right.
IX. Complaints Regarding Goods under Warranty
  1. The Seller guarantees Goods free of defects.
  2. The Seller is liable to Consumers under Articles 556–576 of the Civil Code. Warranty is excluded for Entrepreneurs.
  3. Complaints should be sent to Kosciuschko Group Sp. z o.o., ul. Kredytowa 8/2, 40-562 Katowice, email: contact@hedcomet.com, phone: +48 882 450 411.
  4. To process a complaint, the Client should send the Goods with proof of purchase to the address above.
  5. The Seller will handle complaints within 14 days.
  6. For incomplete complaints, the Seller will request completion within 7 days of notification.
X. Complaints Regarding Electronic Services
  1. Clients may submit complaints about the Online Store and Services via mail or email.
  2. The complaint must include Client’s name, correspondence address, and description of the issue.
  3. The Seller will resolve complaints within 14 days or inform the Client when it will be resolved. Incomplete complaints must be completed within 7 days of notice.
XI. Out-of-Court Resolution of Complaints and Claims
  1. Consumers have the following options: a) submit disputes to a permanent consumer arbitration court, b) contact the regional inspector of the Trade Inspection for mediation, c) receive free assistance from local consumer ombudsmen or organizations (e.g., Consumer Federation, Association of Polish Consumers). XII. Personal Data Protection

The Seller collects and processes Clients’ personal data according to applicable law and the Privacy Policy available on the Online Store website.

XIII. Final Provisions
  1. All rights to the Online Store, including copyrights, intellectual property rights to its name, domain, website, forms, and logos belong to the Seller and may be used only according to the Terms and Conditions.
  2. Provisions regarding Consumers, withdrawal, and complaints apply to individuals entering business contracts if non-professional. Out-of-court dispute resolution provisions do not apply.
  3. Disputes between the Seller and Consumer Clients are subject to courts according to civil procedure law.
  4. Disputes between the Seller and Entrepreneur Clients are subject to the court competent for the Seller’s registered office.
  5. For matters not covered by these Terms, the Civil Code, Act on Electronic Services, Consumer Rights Act, and other applicable Polish laws apply.
  6. Clients will be informed of any changes via the homepage, and account holders will be notified by email. Changes take effect no sooner than 14 days after announcement. If an account holder does not accept the changes, they must notify the Seller within 14 days, resulting in contract termination.
